Montana

Assisted living facilities are congregate residential settings that provide or coordinate personal care, 24-hour supervision and assistance, activities and health-related services. They are licensed by category: A (basic personal care), B (residents who may need skilled nursing or be totally dependent in several daily activities), C (severe cognitive impairment) and D (residents assessed as a danger to self or others, limited to facilities of 15 or fewer residents). Adult foster care homes are a separate license for private homes giving only light personal or custodial care to 4 or fewer unrelated aged or disabled adults.

Key requirements

  1. Administrator must be a licensed nursing home administrator or complete required self-study modules, plus 16 hours of continuing education a year (ARM 37.106.2814)
  2. Enough qualified staff on duty 24 hours a day to meet resident needs (ARM 37.106.2816)
  3. Category B admission requires a practitioner's written order and quarterly health assessments; Category D requires monthly assessments (MCA 50-5-226)
  4. Adult foster care homes: at least one adult who lives in the home permanently and is not employed outside it (ARM 37.100.165)
  5. Adult foster care staff must obtain CPR/first aid certification within 30 days of hire
