Oklahoma

A residential care home provides residential accommodations, food service and supportive assistance to ambulatory residents who can essentially manage their own affairs and do not routinely need skilled or intermediate nursing care. OAC 310:680 has a separate subchapter for homes with three or fewer residents. OSDH issues probationary (120-day), regular and conditional licenses, and settings that provide more care are licensed as assisted living centers under OAC 310:663.

Key requirements

  1. The administrator must be licensed under 63 O.S. § 330.51 et seq. and spend at least one-third of working time supervising on the job (OAC 310:680-1-2, -11-1).
  2. Minimum staffing is 3/4 hour of personnel per resident per day based on average daily census, and someone must supervise whenever residents are present (OAC 310:680-11-1).
  3. Direct care staff need First Aid/CPR, an 8-hour orientation within 90 days of hire and 8 hours of training a year (OAC 310:680-11-1).
  4. Staff who administer medications need a certificate of medication administration training from an institution of higher learning, unless they are licensed nurses (OAC 310:680-11-1).
  5. Resident rights include privacy, freedom from abuse, confidential records and security of possessions (OAC 310:680-19).
