An assisted living facility license is required when a business provides food and shelter to four or more people unrelated to the owner and also provides personal care or medication administration. Type A facilities serve residents who can evacuate without help, can follow directions in an emergency and do not need routine care at night. Type B facilities may serve residents who need help to evacuate or care at night, as long as they are not permanently bedfast. Separately, Chapter 260 lets counties and cities issue permits to 'boarding home facilities', which provide lodging to three or more unrelated elderly or disabled people and community services but not personal care, using model standards written by HHSC.

Key requirements

  1. Manager: 24 hours of initial training and at least 12 hours of continuing education each year (26 TAC §553.253)
  2. Attendants: 4 hours of orientation before any duties, 16 hours of supervised on-the-job training, and 6 hours of annual training (§553.253)
  3. Night staffing: Type B facilities must have staff immediately available and awake regardless of size; large Type A facilities must also have awake night staff (§553.253)
  4. Before licensure: pre-survey training, a fire marshal inspection, and passing Life Safety Code and health inspections
