Type I facilities serve residents who can leave the building without help and provide social care. Type II facilities provide coordinated personal and health care 24 hours a day to residents who may need limited help from one person to evacuate. Both types are also sorted by size: limited capacity (2–5 residents), small (6–16) and large (17 or more). R432-270 was last amended in November 2023 and February 2024, and DLBC updated its inspection checklist on November 4, 2025.

Key requirements

  1. Qualified direct-care staff on site 24 hours a day; a Type II facility needs at least one certified nurse aide on duty at all times
  2. Administrator qualifications depend on type and size (e.g., Type I: 21 or older, with an associate degree or 2 years of health-facility experience)
  3. A licensed health care professional assesses each resident before admission and at least every 6 months, and medications are reviewed at least every 6 months
  4. Staff may administer medications only under RN delegation as allowed by the Nurse Practice Act
  5. Criminal background screening through DLBC (R432-35) and quarterly fire drills on every shift
